The groundwork is laid. The Feasibility Studies are complete. Time is short. 

Ozarks Highlands National Heritage Area is an attempt to establish governmental authority over the Ozarks region. While the proponents of the Heritage Area designation may deny this, excerpts from Ozark Action, Inc sponsored feasibility study and National Park Service documents tell a different story. OPRC will present these and  let you decide what their intentions are. Documents (700+ pages), obtained only by a freedom of information act (FOIA) request, after weeks of waiting for voluntarily shared documents, show that they had fear of property rights advocates getting access to these documents. That fear was substantiated. Promoters have taken pains to hide the facts about this program. They have quietly gone about ‘’selling” the ”program”, telling unsuspecting County Commissioners and Community leaders how this program will help save our ‘’stories”, market local products, & bring busloads of tourists to their area.

Documents detailing what has happened  to landowners in other Heritage Areas do not paint a pretty picture. Once the National Park Service hands down its “guidelines,” property rights go out the window. And there is no “opting-out.” Steve Hodapp ( formerly worked with the National Park Service  to create the NHA program and was point person for NHA legislation on the House Resource Committee) said,  ”It (opting-out) is a physical and geographical impossibility. One is either inside the boundaries of a National Heritage Area, or outside the boundaries. And if one is within the boundaries, and there is a management plan that prescribes, indeed mandates, programs and activities to protect, enhance, and manage natural and scenic values within the National Heritage Area—in one way or another private landowners are not goint to be allowed to convert their cornfield to a pig farm or paint their silo purple with yellow stripes.”  From The Virginia Land Rights Coalition website.  NHA Testimony from Robert J. Big Government puts crosshairs on the Ozarks

 There have been several attempts over the years by the Federal government to establish it’s authority over the Ozarks region. These include; The Wild and Scenic Rivers Act, The Natural Streams Act, the FEMA Hazard Mitigation plan, the United Nations ”Man in the Biosphere” designation, Scenic Byways designations, and now, the Ozarks Highlands National Heritage Area. This most recent effort consists of 13 Ozarks counties including, Wright, Douglas, Ozark, Texas, Howell, Dent, Reynolds, Iron, Wayne, Carter, Ripley, Shannon, and Oregon being taken under the jurisdiction of the National Park Service and the global planners. While the proponents of the Heritage Area designation may deny this, I will share gleaned excerpts from two feasibility studies taken in 2010 that were sponsored by Ozark Action and let you decide what their intentions are.
 
Ozark Action and other promoters of this scheme have taken great pains to hide the facts about this program. They have quietly gone about their business of ‘’selling” the ”program”, telling unsuspecting County Commissioners and Community leaders wonderful things about how this program will help save our ‘’stories”, and also improve our economy by promoting tourism and marketing of local products. These are wonderful things I agree, but let me share the dark underbelly of this program.

  The Ozark Highlands National Heritage Area feasibility studies, which were only obtained by a freedom of information act (FOIA) request after weeks of waiting for voluntarily shared documents, show that they had great fear of property rights advocates getting access to these documents. That fear was substantiated.

 It’s doubtful the supporters of the program on the local level, including all thirteen county commissions, had ever read or were ever shown these documents. There are over 700 pages on this program to date. I have found that government officials almost never have the documents available and never want you to read them, they just want you to believe what a wonderful program it will be.
 
 The OHNHA  feasibility study documents say the following (my comments in italics):

 Page 1  “The National Heritage area program has been developed by the National Park Service.”  This program will basically take our 13 counties under the jurisdiction of the United States Park Service.

 Page 54  “Incorporate approaches employed by European nations for preserving parks and other special places without removing them from the life and culture of the nation.”
That is a system where everything is regulated, permitted, and controlled. You will no longer control your private property. You will now be in a National Park. They call it a ”Heritage Area”, but it will give them control over you and your property when fully implemented.

 Page 54  “ The formal administration of the National Park Service of the National Heritage Area program in the Ozarks Highlands would likely continue to facilitate a culture of distrust of the National Park Service in the area, particularly by private property protection groups and alternative heritage preservation methods would likely be preferred.”
Seems as if they understand there will be opposition to their program once the information got out. They are trying to figure out how to keep us from understanding the Park Service will be in charge. How? Local representation is appointed, not elected, but Park Service will have final say because everything must match up with their ”criteria” or goals to keep the designation and keep the federal dollars flowing.

 
Page 57 “The efforts of the national heritage area program to facilitate the goals of the NPS guideline are foremost….”
This will be a gradual takeover of our area by the Park Service and it’s global goals. European style management systems? The facts are clear.

 
Page 58 “Public officials from EVERY COUNTY have been contacted and been provided information concerning the function of a National Heritage Area and have offered their support towards this effort.”
Did your local official read the documents about this program? Did they have any idea what they were signing on to support? Have them read this letter and ask them to get these feasibility studies and read it for themselves. Have them research and Agenda 21 and Sustainable Development. This is the socialist style of land control. Do we want that in America?

 
Page 58  “Special attention has also been made toward those groups who are interested in Private Property Protection to provide them with information and documentation in this process.”
We just received these documents after weeks of waiting and only then by FOIA requests. When we met with officials from Ozark Action and other supporting entities no official documents were produced. I suspect no community leaders understood what was happening either. Warning; Get educated about Sustainable development and Agenda 21. All the federal and state agencies are promoting these concepts and programs. They cannot be trusted to tell you the details of these programs. It’s likely that they don’t know the details themselves. DON’T BE FOOLED!

 
Page 58  “…the National Heritage Area would likely have no negative impact on economic activity.”
Resource control, regulations, planning, permitting, unelected boards determining the future of your farm or business.Increased taxation to bring the Heritage Area into “self reliance”… This will have NO impact? Are you kidding?? Key word is ”likely”.
 
Page 59  “This sustainable development approach…”
Again, this is sustainable development. Google or youtube it. Lot’s of good information on the about this program.

 
Page 23  “Management” Specified actions, policies, strategies, taken to meet the goals and recommendations of the heritage area.
The National Park service will tell the local committee what they must do to get funding. They must meet the NPS guidelines and criteria. NPC will pick who is on the board and what they do. This is the Soviet style of governing by council and committee. We have elected officials and a State and Federal Constitution. I think we should stick with that. Soviet means unelected or appointed councils that rule. This is what the regional planning centers, Federal Agencies and these other schemes are all doing, creating another layer of government over our Constitutional one. This is the socialist model of governing. Most elected officials have no idea what is happening.

 
 
Page 23  “Resource Protection” the act or process of preventing, eliminating, or reducing human-caused impacts to natural resources and natural processes.
This is the ultimate goal, total control over our farms and businesses. Permits, regulations, inspectors, boards, and councils that can take over control and implement the new federal agency guidelines of Agenda 21 Sustainable Development. This will destroy our property rights and destroy our system of government. Are you feeling GREEN?….

 
In conclusion;
 
I have very briefly described the plan. They keep trying to gain control and are slowly doing so. As I said before, all the federal agencies are working towards these goals. Our founders were very wise in the way they set up our government, this system goes around our constitutional protections. This has been going on for many years.

 
The Ozark Highlands National Heritage Area is ready to be adopted. It takes an act of Congress to do it. They have all the local support from our elected officials they need according to their documents, all 13 counties!

 
They are currently working to get this adopted and in place for our region. If you are against this, immediately contact your elected officials, County Commissioners and mayors. Give them this letter. Ask them to get the feasibility studies and get educated about sustainable development and what this Heritage Area designation area will really do. Get them to send letters to Ozark Action rescinding their letters of support immediately. Call your Congresswoman Jo Ann Emerson and ask her not to support this declaration. Educate your friends and neighbors about this program. This is an immediate threat to our property rights and freedom to use our land and streams.

 
If we lose our private property rights. They may be lost forever.

Meeting Topics

We requested & have received some Freedom of Information Act documents concerning Ozarks National Heritage Area. It is obvious from the documents that the process of forming the NHA is further along than their committee led us to believe. The more we see of the documents, the more we oppose this National Park Service land control measure, disguised as preserving the “heritage of the area.” Initiated by several folks in West Plains, this measure will do nothing to bring jobs & money into the 13 counties it will cover. It will put tax dollars in the pockets of the ones who initiated it. Research into some of 37 other NHAs reveals that some have used their federally acquired authority to impose restrictive zoning requirements on the region’s property owners to limit development and/or to force it into directions agreeable to those who guide the management of the National Heritage Area. Can we afford to take that chance with our private property rights?

 Morningland Dairy has had a day in court (rather 2 long days in court). Doreen will be reporting on what happened in the West Plains courtroom.

 S. 510, the so-called “Food Safety Bill” has been passed & signed into law. What next? A meeting was held at the Springfield Livestock Auction on the 18th to discuss what our next steps should be to protect our right to grow food and eat what we want to. Doreen will have more information for us.

Morningland Dairy’s First Day in Court

West Plains, Missouri - Monday, January 11, 2011 -  Today was Morningland Dairy’s first day in court. Getting into the court room was almost like trying to get on an airplane, except for no one ‘touched your junk’, and I didn’t see any naked scanners there. You simply couldn’t even bring in a purse, laptop, cell phone or bottle of water.  The law enforcement monitoring entry seemed to ease up a bit as the day wore on, but at first it was pretty durn tense out in the entry area.

 Roughly forty five people were in the audience, and it filled the little spectator’s vestibule in the Howell County Missouri Court House.  The unusual number in the audience drew Judge Dunlap’s attention and he commented upon it during his opening instructions on proper court room decorum.  The presence of so many people  on a very cold day when all area schools were closed because of questionable roads illustrates the importance of this case to the residents of South Central Missouri.

 While this is just a small update for those who have been supportive of the dairy, there a tremendous amount of detail that was covered in the testimony given today. The majority of the day was taken up with the testimony of Gene Wiseman, Executive Secretary of the Missouri Milk Board, and Don Falls, Environmental Specialist and lead Missouri Milk Board investigator and inspector of Morningland Dairy plant.
 
In my opinion, Gary Cox, attorney for Morningland from Farm to Consumer Legal Defense Fund, did a pretty good job on cross-examination. As many of you know, I have been somewhat critical of Mr. Cox in the past, and I simply want to give credit where credit is due.  He did a good job today. So, a hat tip to Gary Cox is in order, and I will give it!
 
Wiseman stated that he ordered an embargo on Morningland Dairy’s cheese without any actual knowledge of contamination. That he had never scheduled a destruction date with Morningland, and that the State of Missouri had assumed all FDA documents, except for the one Cox showed him about investigations of dairy facilities. There is no state statute or regulation that categorically states that Missouri has accepted and adopted all FDA guidelines or standards….and the Attorney General’s office tried to disallow questioning about the FDA as hearsay. But since Don Falls worked with the FDA on their investigation of Morningland, it was allowed after all.

 Judge Dunlap is rather unorthodox in his courtroom manner. Initially I thought he was entirely too helpful and lenient with the Attorney General’s office. I have never seen a Judge help to rephrase counsel’s questions after objection in the way that he did.  But he showed the same latitude with Mr. Cox’s cross examination, so I think it is just his demeanor and it wasn’t apparent to me that he was showing bias in favor of the prosecution. Additionally, his questions for his clarification of the two Missouri Milk Board witnesses were germane, intelligent, and astute. So it doesn’t appear on its face that we are actually dealing with a foregone conclusion in favor of the State in this case.
 
All  who are able to attend the trial in the morning, (9am Central) just a few hours from this writing, are encouraged to do so.  While the pace of today’s proceedings seems to indicate that the trial would have to continue into Thursday, it is scheduled to wrap up on Wednesday the 12th of January, 2010. All who attended today are deeply appreciated!

 I will do  a more thorough overview of the court case itself in the next couple of days, but not being allowed a laptop for note taking purposes makes this part of my job a little more difficult! Just remember, if you come to the Howell County Court House, leave everything outside in your car except for your keys. You can put those in the little bucket and walk through the detector.

No January OPRC Meeting in Gainesville

Meeting postponed until February 10

Due to the prospect of extreme cold and inclement weather, the decision has been made to postpone the January OPRC Meeting in Gainesville until February 10.

Also factoring into the decision to postpone is the prospect of having much more information on the proposed 13 county Ozarks National Heritage Area. We have in our hands the 702 page FOIA documents regarding this proposal. It will take a little time to examine what this tome contains.

So, weather permitting, we will see you on February 10, 2011 at Vaught’s Family Restaurant, on Highway 160 west of Gainesville, Missouri at 7:00 p.m. On meeting nights food is served from 5:00 p.m. to 7:00 p.m.

Weather permitting, there will be a OPRC meeting in Mountain Grove, Missouri at the Hayloft Restaurant at 7:00 p.m. on January 27. Come early, if you care to eat, as no food is allowed in the meeting room, due to limited restaurant staff.

Raw Dairy Cheese Plant Battle Goes to Next Level

 Morningland Dairy LLC, the Missouri farmstead raw cheese plant that has been shut down by embargo since August 26th, is finally going to get its day in court. On Tuesday January 11th, in West Plains, Missouri, at Howell County Court House, the trial will begin.

 Don Falls, Joseph Frank, and Roger Neill, have been deposed as State witnesses on behalf of the plaintiff, Missouri Milk Board. The Missouri Attorney General is charging Morningland Dairy with three criminal charges and a preliminary injunction order to destroy their entire cheese stock. Mr. Falls is the lead inspector of Morningland for the Missouri Milk Board, and was present at the cheese plant for virtually the entire investigation.

Denise Dixon, co-owner and General Manager of Morningland Dairy and Jedadiah York, Morningland’s Plant Manager and others have been deposed on behalf of the defendants.
 

Morningland is charged with selling illegal dairy product, interfering with the Milk Board in the execution of their duties, and refusing to comply with a destruction order. These are all Class A Misdemeanor charges with a $1,000 or 1 year in jail sentence possible.

 Attorney for Morningland Dairy, Gary Cox of Farm to Consumer Legal Defense Fund is asking for a jury trial in the case. Morningland Dairy denies all charges. Denise Dixon says, “We are a licensed and inspected facility and haven’t made or sold any of our cheese since the embargo was issued. The only infraction we may have committed was to ask the Milk Board for the right to test our cheese properly instead of simply destroying it.”

 The case is one of several current raw cheese plant shut downs in the nation.  Morningland Dairy has been in operation for 30 years and has no reports of illness associated with consumption of their product in that time.

I will speak plainly, Freedom and Liberty are being stolen from us and our children at an astonishing pace now. Shall we be known as the generation that accepted it without a whimper?

A report on the National Heritage Area meeting held in Cabool onNov. 23rd. OPRC gave notice to the committee from West Plains, that we will actively and vigorously oppose this 13 County Federal land zoning proposal.

The latest on the Missouri Milk Board’s tyranny against Morningland Dairy. The Milk Board, with the help of Missouri’s Attorney General, has taken a dictatorial stance in this case. They have charged Joe and Denise Dixon with three counts of violating state law. Evidently it is even a violation of state law to file an objection to the dictates of the Milk Board. The Senate vote on S. 510, the so-called “Food Safety Bill” has been postponed until Monday, Nov. 29, 2010. Fax and call your senators and tell them to oppose S. 510. (Make no mistake, American farmers and all local food producers are under attack. If this bill passes, farmers throughout America, large and small, will be out of business in less than 24 months.
